NGOs ‘Friends of Court’ in Defamation Case
Wednesday, August 25, 2010 - 09:44
Two NGOs have been admitted as friends of the court in the defamation case involving three former schoolboys found to have defamed their deputy headmaster.
The Freedom of Expression Institute (FXI) says the Supreme Court of Appeal’s judgment is likely to have an unjustified chilling effect on the right of children to critical, and particularly satirical, expression.
The FXI is of the view that, ““This appeal, therefore, presents an opportunity for this court to consider and, if necessary, develop this nascent jurisprudence, and to pronounce on the meaning and scope of children’s rights to freedom of expression.”
The Restorative Justice Centre, on the other hand, suggested that the restorative justice system is preferable to deal with offences caused by children.
