Child Abuse:The Law plays ping pong matches; children suffer

We have lived through a situation of total agression from father of two children and family. These children have not received R1 of maintenance in almost two years. The two children were victims of drug fights. They were also molested by the paternal grandfather. Welfare sent them to maternal grandparents with mother, who had had a breakdown due to total alienation and vulnerability in the home - where there was often no food. THE LAW WAS THEN USED AS A LEVER TO TRY TO BREAK THE MATERNAL GRANDPARENTS THROUGH MULTIPLE HIGH COURT ACTIONS COMBINED WITH NO MAINTENANCE, THE AIM BEING TO GET THE CHILDREN REALLOCATED BACK TO THE HOME OF THE FATHER AND MOLESTING GRANDFATHER. THE LAW HAS DONE NOTHING TO TRY TO PROTECT THESE CHILDREN, OR THOSE WHO ARE TRYING TO PROTECT THEM, IT IS A PING PONG MATCH ALLOWING ONGOING ABUSE BY ABUSERS. AN R43 REQUEST FOR MAINTENANCE BECAME ANOTHER PING PONG LEGAL MATCH. A JUDGE SIGNED AN URGENT REQUEST TO RETURN THE CHILDREN TO THE HOME AT WHICH THEY WERE MOLESTED. IT COST A HUGE AMOUNT TO DEFEND THESE CHILDREN AGAINST THIS REQUEST. HOW COULD A JUDGE SIGN THIS?? HOW CAN EVEN OPPOSITION LAWYERS PROMOTE THIS, WHICH IS AGAINST THE CHILD ACT. THE LAW IS A FARCE. Implementation of the Children's Act

There is a need to translate the Act into action and there is a need for social workers to acquaint themsel;ves with the Act fully
Childline has reported that a million phone calls were made to its crisis counselling line last year - the most it ever received.

Childline Managing Director, Joan van Niekerk, told Parliament’s Portfolio Committee on Women, Children and People with Disabilities that the increase in the number of child-abuse related calls coincided with the government’s failure to implement most sections of the Children’s Act which came into effect in 2005.

The Committee was shocked when told that only 30 of 300 sections of the Children’s Act had been implemented.
